However, if the tenant is in breach of the agreement the landlord will be able to seek possession at any time.
A landlord has the right to seek possession under accelerated possession proceedings after the initial 6-month term as long as the tenant has been given notice of this, under Section 21 of the Housing Act 1988. The earliest this can therefore be served is after the fourth month of the tenancy agreement.
