Changes to probate fees

With so much attention on hot weather, global unrest and the rising cost of living, other important changes can easily slip under the radar. One such change is the Ministry of Justice's planned increase to the probate application fee.

What is changing?

  • The probate application fee is expected to rise from £300 to £526, an increase of around 75%
The cost of copies requested at the time will conversely is expected to fall from £16 to £2 each.
The change is due to take effect 13 July 2026.
Applications currently awaiting HMRC information or a specialist code may be affected if they cannot move to the next stage before the new fee applies
  • The Ministry of Justice says the increase is intended to help “cover the full cost of the service provision” and support a more modern and efficient service.  It remains to be seen whether the additional funding will translate into an improved probate service

Why professional guidance matters

Although the increase is unwelcome, dealing with probate without professional support can be a false economy.  A DIY approach may appear to save money at the outset, but can add delay, uncertainty and stress at an already difficult time.  If the estate is likely to attract inheritance tax (as the fiscal drag of the frozen nil rate amounts drag more and more estates into the tax system), professional support can ensure that tax is kept to a minimum by careful calculation and the application of available releifs.
